OpenHosting Acceptable Use Policy (v1.0)
OpenHosting Web Hosting's facilities and services may not be used in
any way which violates Federal, State, Local, or International
law. Additionally, OpenHosting's Acceptable Use Policy prohibits the
following activities:
1. UNSOLICITED E-MAIL. Sending unsolicited bulk and/or commercial
messages over the Internet (known as "spamming", "junk mail") is
expressly prohibited. Once a Customer account is determined as
source of unsolicited e-mail, such account will be immediately
suspended. Account reinstatement shall be subject to $500
reinstatement fee. Additionally, maintaining an open SMTP relay, as
well as forging or misrepresenting of message headers to mask the
originator of the message is prohibited.
2. INTELLECTUAL PROPERTY VIOLATIONS. Engaging in any activity that
infringes or misappropriates the intellectual property rights of
others, including copyrights, trademarks, service marks, trade
secrets, software piracy, and patents held by individuals,
corporations, or other entities. Also, engaging in activity that
violates privacy, publicity, or other personal rights of
others. Such violations not only may result in Customer account
termination, but also may result in civil and/or criminal
penalties.
3. OTHER AUP VIOLATIONS. Engaging in activity affecting another
network that does not comply with restrictions posed by the other
networks' terms of service or acceptable use policies.
4. OBSCENE SPEECH OR MATERIALS. Using OpenHosting's facilities to
advertise, transmit, store, post, display, or otherwise make
available child pornography or obscene speech or
material. OpenHosting is required by law to notify law enforcement
agencies when it becomes aware of the presence of child pornography
on OpenHosting's facilities.
5. MALICIOUS SOFTWARE AND DESTRUCTIVE ACTIVITIES. Distributing
software to produce viruses, worms, Trojan horses, pinging,
flooding, mailbombing, or denial of service attacks. Also,
activities that disrupt the use of or interfere with the ability of
others to effectively use the network or any connected network,
system, service, or equipment.
6. UNAUTHORIZED OR ILLEGAL ACCESS TO OTHER NETWORKS. Accessing
illegally or without authorization computers, accounts, or networks
belonging to another party, or attempting to penetrate security
measures of another individual's system (often known as
"hacking"). Also, any activity that might be used as a precursor to
an attempted system penetration (i.e. port scan, stealth scan, or
other information gathering activity).
7. ATTEMPTING TO BYPASS OPENHOSTING SECURITY. Customer may not attempt
to bypass any security mechanisms in place on OpenHosting Web
Hosting's system, or use any of OpenHosting Web Hosting's systems
or services to attempt to bypass any security mechanisms in place
on any remote system. This includes, but is not limited to, running
any password cracking software, or attempting to access a system
which any Customer knows or reasonably should know he or she is not
authorized to access in the manner or to the extent attempted.
